In the event of any conflict between these Terms and the Rental Agreement, the terms of the Rental Agreement shall prevail with respect to the rental transaction.

Equipment availability, pricing, and specifications shown on our website are indicative only. To confirm availability and receive a formal quotation:

The purchase of equipment from Britannia Equipment is subject to our separate Sales Agreement, which will be provided to you before any purchase transaction. The Sales Agreement contains specific terms regarding:

  • Pricing and payment terms
  • Delivery or collection arrangements
  • Warranty provisions
  • Return policies

In the event of any conflict between these Terms and the Sales Agreement, the terms of the Sales Agreement shall prevail with respect to the purchase transaction.

7. Payment Terms

7.1 Pricing

  • Exclusive of Value Added Tax (VAT), unless otherwise stated

The final price for any equipment or service will be confirmed in your formal quotation or invoice.

7.2 Payment Methods

For equipment rentals, a security deposit may be required before delivery or collection.

7.3 Invoicing and Payment Due Dates

  • Deposit plus balance payment for equipment purchases
  • Payment within 30 days of invoice date for account customers with approved credit

We reserve the right to charge interest on late payments at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

8. Warranties and Disclaimers

  • Rental equipment is provided in good working order, but day-to-day maintenance remains the customer's responsibility
  • Service and repair work warranties are typically 30-90 days for parts and labour

No additional warranties are provided beyond those explicitly stated in the relevant agreement.

9. Limitation of Liability

9.1 Scope of Limitation

To the maximum extent permitted by applicable law, Britannia Equipment shall not be liable for:

  • Any indirect, consequential, special, incidental, or punitive damages
  • Loss of profit, revenue, business, opportunity, anticipated savings, goodwill, or reputation
  • Any loss or damage arising from your use of, or inability to use, our website or services
  • Any loss or damage arising from reliance on information obtained through our website

9.2 Exclusions from Limitation

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under applicable law

9.3 Liability Cap

Where our liability is not excluded, our total liability to you shall not exceed:

  • For equipment rental or purchase: the amount paid by you for the relevant equipment
  • For services: the amount paid by you for the relevant service
  • For website use: £100

10. Indemnification

You agree to indemnify, defend, and hold harmless Britannia Equipment, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your misuse of our website, equipment, or services
  • Your negligence or wilful misconduct

11. Termination

We may terminate or suspend your access to our website or services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

  • Your right to use the website and services will cease immediately
  • You must return any rented equipment according to the terms of your Rental Agreement
  • Any outstanding payments will become immediately due

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on the website with a new "Last Updated" date. Your continued use of the website following the posting of revised Terms means you accept the changes.

For material changes, we will make reasonable efforts to provide notice, such as an announcement on our website or an email notification if you have provided contact information.

13. General Provisions

13.1 Governing Law

These Terms, together with any applicable Rental Agreement, Sales Agreement, or Service Agreement, constitute the entire agreement between you and Britannia Equipment regarding the subject matter hereof and supersede all prior or contemporaneous understandings.
